The following groups of child-caregivers MUST COMPLY with state required regulations regarding pool-safety-fencing codes:

  • Foster Parents
  • Foster-to-Adoptive Parents
  • Hoping to Adopt
  • Adoptive Parents
  • Kinship
  • Licensed Child-Care Providers

Good News! Desert Pool Guard Removable Mesh Pool-Safety Fencing and Self-Closing-Child-Proof Lockable Gates comply with all California pool-safety laws requirements to adopt a child, provide kinship, take in a foster child, or be a child-care provider. The California law requires that not only does the protective pool-safety fencing have to enclose your pool, but it MUST be installed to completely isolate your swimming pool and spa area from any ways to access it from the home, including through doors, windows, and garages!

Desert Pool Guard complies with the California Department of Social Services pool-safety-codes required for Foster Parents, Foster-to-Adoptive Parents, Adoptive Parents (or those hoping to adopt), Kinship (Kin-GAP), and Licensed Child-Care Providers who have a swimming pool. Desert Pool Guard Complies With California Department of Social Services (CDSS)

Requirements for Swimming Pool Safety Fencing and Pool Covers

According to California Department of Social Services (CDSS), all homes that accept children under 10 years of age or a child that has a condition including one that makes the child developmentally disabled, or mentally handicapped, and for whom special care and supervision is required as result of his/her condition, shall ensure the inaccessibility of all pools, spas, and bodies of water. Desert Pool Guard adheres to all CDSS laws by incorporating the following pool-safety features required for foster and adoptive parents, kinship, and child-care providers. These are features that inspectors and social workers will be checking for:

  • The swimming pool or spa area must be isolated from access to/from a home with a sturdy 5-foot pool-safety-fence-barrier as defined in Section 115921(c)
  • The pool-fencing must not obscure or block the pool from view and meets the requirements of Section 115923 of the Health and Safety Code
  • Pool-fencing-system (with child-proof-self-closing and lockable-gate) must completely surround the pool or spa isolating the area from any doors or windows, or garage that are accessible from the house within that enclosed area.
  • A property fence, and side of the house can be considered a safety-barrier just as long as together with added pool-fencing and lockable-gates, the pool area is completely enclosed with no access to home doors or windows, or other openings to the pool area
  • A 5-foot self-closing gate (minimum height 60”) that latches and locks within 30-seconds
  • The gate-lock is no more than 6-inches from the top of the gate
  • A maximum vertical clearance of 2-inches from the ground to the bottom of the swimming pool-fencing system
  • Gaps of voids in the pool safety fencing, if any, does not allow passage of a sphere equal or greater than 4-inches in diameter
  • The outside surface of the pool-fencing-system is free of protrusions, cavities, or other physical characteristics that could serve as handholds or footholds that could enable a child below age-5 to climb over the fence
  • The pool gate must open away from the swimming pool, spa, pond, hot tub, wading pool, or other similar bodies of water
  • A lockable swimming pool or spa cover has to support the weight of an adult

Basically, there will be required home inspections by local health departments, code enforcement officers, in addition to visits by a social worker to ensure that your home offers a pool-safe environment for a child, and that you meet state licensing standards for swimming-pool-barrier safety. The pool-safety experts at Desert Pool Guard are here to help you get ready for this inspection.
